What is Child Maintenance?
There are three main ways to arrange this Family-Based Arrangement: A private, flexible agreement made directly between parents.
Direct Pay: The CMS calculates the amount, but you pay each other directly.
Collect and Pay: The CMS collects the money from the paying parent and passes it to the receiving parent (additional fees apply).
How is Child Maintenance Calculated in 2026?
The CMS uses a six-step process to determine the weekly amount. Key factors include:
The Paying Parent’s Gross Income: Usually pulled directly from HMRC records.
Number of Children: The more children you support, the higher the percentage of income required.
Shared Care: If the child stays overnight with the paying parent (at least 52 nights a year), the amount is reduced.
Other Children: Deductions are made if the paying parent supports other children in their new household.
Statutory Rates for 2026/27
Basic Rate: For parents earning between £200 and £800 a week.
Flat Rate: A fixed £7 per week if the parent is on certain benefits or earns very little.
Default Rate: Used when income is unknown—£38 for one child, rising for more children
